Please read these Terms carefully before ordering Products from our website. By ordering any Products from our website you agree to be bound by these Terms.

 

1. Formation of the contract

Once you have placed an order you will receive an email from us acknowledging receipt of your order. Please note that this does not mean your order has been accepted. Your order constitutes an offer to buy Products from us. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the order is being processed. The contract between us will be formed as, once we have verified the availability of all the Products in your order, we send you a confirmation email that we are processing your order, which includes giving you all the information you need to pay your order.

We reserve the right to:

  • decline any order (or part of any order) where the Products are unavailable for any reason;
  • decline any order (or part of any order) where the Website has contained obvious errors or inaccuracies in relation to the description of a Product or the pricing of a Product (see section 3 – Prices for more information about this point);
  • place restrictions on the volume of any Product ordered where the availability of a Product is limited;
  • place restrictions on the volume of any Product ordered in accordance with our standard procedures relating to compliance with the laws and regulations in your territory.

 

2. Products

You will become the owner of the Products when they have been delivered to you, and such they fall under your responsibility. Once Products have been delivered to you they will be held at your risk and Ars Manufactorea will not be liable for their use, loss or destruction.

 

3. Prices, Payments and Discounts

Discounts shown on our site are only valid for purchases made on the site itself, except for the “Special Offers” category that is equally valid for both online purchases and for those made in our physical store.

We will apply a discount of 9% on all products in our store catalog, a discount of 14% on all Privateer Press products and a discount of 19% on all boxes, blister and books by Games Workshop (always rounded to 0,10 € excess).

Upon request it is possible to place orders on our website and then come to pick them up in person to our store. In this case the discounts reserved to the online store won’t be applied, even if the payment is made online.

The price of any Product will be as quoted on the Website from time to time, except in the following circumstances:

  • Our Website contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on the Website may be incorrectly priced. Where a Product's correct price is less than our stated price, we will charge the lower amount when despatching the Products to you. If a Product's correct price is higher than the price stated on the Website, we will, at our discretion, either contact you for instructions before despatching the Products, or reject your order under condition 1 of the present Terms and notify you the reason of such rejection.
  • Ars Manufactorea is under no obligation to provide Products to you at an incorrect (lower) price, even after we have sent you a confirmation e-mail, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

All products prices of the respective brands are clearly shown on our website in the relevant sections. Such information is subject to change without notice. Please frequently update your browser page to make sure you view the correct prices. Prices are displayed inclusive of any applicable VAT.

Product prices exclude delivery costs that will be added to the total at checkout of the order. Details of shipping costs may be displayed on the Shippings page of our site.

Payment for all Products must be made through one of the available methods at check-out: bank transfer, cash on delivery, post-pay or paypal. No other forms of payment other than those listed are accepted.

 

4. Gift Cards

As well as purchasing Products through the Website, you can also purchase Gift Cards for yourself or other people.

Gift Cards are only usable on our website, cannot be exchanged for cash and are not transferable or assignable in any way.

Each Gift Card has a unique activation code: once a Gift Card is purchased and the buyer has selected an e-mail address to deliver it, the code will be sent to the recipient. Responsibility for the Gift Cards passes to the recipient upon purchase and Ars Manufactorea is not responsible for Gift Cards which are lost, destroyed or used without the Recipient’s permission.

We are not responsible for incorrect or undeliverable email addresses.

If any order placed by the recipient using the Gift Cards exceeds the value of the Gift Cards held by the recipient, any balance remaining for a purchase must be paid by the recipient. One or more Gift Cards can be redeemed against a single order.

Gift Cards expire 24 calendar months after the date of purchase.

All other provisions of these Terms will apply to all purchases made using Gift Cards, as applicable.

 

5. Product Delivery

The Products will be delivered to the address specified in your order and in accordance with the delivery option selected at the point of checkout. Please see the Order History page in your account for specific details of despatch and delivery times.

Whilst we will take reasonable steps to ensure that your order is despatched and delivered on time, please be aware that despatch and delivery times are estimates only, and that time of despatch or delivery is not of the essence of any contract. Where any Product is manufactured or produced to order by you, an estimated delivery time will be specified at the point of ordering. A more detailed delivery time will then be specified. By placing an order for a Product manufactured or produced to order, you acknowledge that delivery may be subject to substantial lead times.

We may defer the date of despatch or delivery or cancel any contract, or remove from your order any Products ordered by you (without liability) if we are prevented or delayed in the carrying on of our business, due to circumstances beyond our reasonable control, including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, extreme weather conditions, flood, epidemic, lock-outs, strikes or other labour disputes, fuel shortages, restraints or delays affecting carriers, or inability or delay in obtaining supplies of adequate or suitable materials. 

We will use reasonable endeavours to ship all of your order together in one shipment. But we reserve the right to ship your order in instalments should some components of your order be unavailable for delivery, or have delayed availability, when you place your order, or if your order is too big to deliver in one shipment. In these circumstances you will be charged a single delivery fee for the whole of your order.

We will use all reasonable endeavours to ensure that the Website displays the correct availability of Products for ordering. To the extent that we are reasonably able to do so, we will identify any limitations on availability (that we are aware of at that time), such as temporarily out of stock Products, in the relevant Product listing page. The provisions of this condition are subject at all times to the provisions of condition 1.

 

6. Returns & Refund

In order to exercise the right of withdrawal, within 14 days from the Product’s arrival - as required by law, the Product must be intact and returned in its original packaging, complete in all its parts; the shipping costs for the return of the goods are in charge of the seller. Under no circumstances returns will be accepted if unauthorized or in makeshift packaging.

You can exercise your right of withdrawal in the following cases:

  • The Product received is not the Product the buyer has ordered
  • The Product received is damaged
  • The Product received is missing in some parts

We offer two possible solutions:

  • Refund: The refund procedure consists in refunding the entire amount spent by the buyer to purchase the Product or the Products in question.
  • Product Exchange: Product exchange consists in replacing the Product or Products ordered with another Product or other Products of the same value, this equal to the amount spent by the purchaser for the purchase of the Product or Products in question.

The right of withdrawal can’t be exercised for made-to-order or custom Products made especially for the buyer.

Your return/refund status can be viewed in the "Your Returns" section of your account.

Opening a return policy involves canceling the Contract of purchase. In order for the return form to be opened and examined, the contact must contain the following information: buyer's name, recipient address and order detail (order number, ordered Products and order date).

When you cancel a contract by choosing to get a refund, we will process the refund due to you no later than within 14 days of receipt of the relevant Products back from you. We will refund the price of the returned Product in full, including the cost of sending the item to you. We will usually refund any money received from you by using the same method originally used by you to pay for your purchase.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of, or in connection with, any defect with a Product, and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Product in question.

Nothing in these conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence or fraud.

 

7. Import Duty

It is possible that your order may be subject to import duties and taxes which are levied when the Products reach specified destinations. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount.

 

8. Other Information

The Contract is binding on you. You may not transfer, assign or otherwise deal with or any of your rights or obligations arising under the Contract.

If any of these Terms or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

These Terms, together with our Privacy Policy, the sections on the site dedicated to sales, shippings and discounts, and any other document expressly referred to in these sections, constitute the whole agreement between us and supersede any previous arrangement, understanding or agreement between us, relating to the subject matter of any Contract. Ars Manufactorea acknowledges that, in entering into a Contract, neither of us relies on any statement, representation, assurance or warranty of any person (whether a party to that Contract or not) other than as expressly set out in these documents. Nothing in this clause shall limit or exclude any liability for fraud.

Failure or delay by Ars Manufactorea in enforcing or partially enforcing any provision of a Contract shall not be construed as a waiver of any of our rights under the Contract. Any waiver by us of any breach of, or default under, any provision of a Contract by you shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other terms of the Contract. 

Ars Manufactorea has the right to revise and amend these Terms from time to time. The latest version of these Terms will be available on the Website. You will be subject to the policies and Terms in force at the time that you order Products from us.

No term of any Contract shall be enforceable by a person who is not a party to the Contract.

To the fullest extent permissible, any dispute or claim arising out of or in connection with a Contract or its subject matter or formation (including non-contractual disputes or claims) will be governed by Italian law and subject to the exclusive jurisdiction of the courts of Italy.

 

8. Complaints Policy

Ars Manufactorea is committed to providing a quality service to you and value your views, opinions and feedback on any Products which have been supplied to you or the service which we have provided to you. If we have not performed any of our duties to a satisfactory standard please contact us and we shall endeavour to put right any problems.
